Exponential Terms and Conditions (“Agreement”)

Please read these Terms and Conditions (“Agreement,” “Terms and Conditions”) before using exponential.net (“the Site”) operated by Exponential. This Agreement sets forth the terms and conditions for your use of the membership portion of the Site at exponential.net.

By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to these Terms and Conditions.

Intellectual Property The Site and its original content, features and functionality are owned by Exponential and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.  Exponential aggregates and distributes a wide range of content from hundreds of leaders and sources. This aggregated content remains the intellectual properly of these leaders and not of Exponential. Exponential provides this aggregated content as a service to church leaders in fulfilling our mission to distribute thought leadership. The methods, manners and delivery of the aggregation are the property of Exponential while all content remains the intellectual property of the author of the content.

Use of the Digital Access Pass is subject to these terms and conditions:

1. Digital Access Pass content is for personal and team use and may not be reposted, modified or sold without permission of Exponential. The purchase entitles you to use the Digital Access Pass on one individual’s computer or mobile device. That person may show and use the material to train team members but may not further distribute the content beyond the individual purchaser’s computer. Distribution limitations are similar to songs purchased on iTunes. The songs may be played for other people via the purchaser’s device, but they may not be copied and further distributed to other individuals.

2. Purchasers may NOT share their passwords for others to download content. Content may only be downloaded by the purchaser to their computer.

3. Content will be available to download for one year after the date of purchase.

4. Purchases are non-refundable.

User Personal Information Exponential.org is a membership site that collects limited personal information including, but not limited to, name, address, email and phone. Credit card information is collected only for purchases made on the site and via reputable industry standard third-party collection solutions (e.g., authorize.net for credit cards). Credit card information is not maintained or stored on our site. We do not and will not collect social security numbers.

Privacy of Basic Information By registering for any membership level, the User agrees to allow Exponential to use basic personal contact information (e.g., email addresses) to interact with Users and keep them informed of information considered relevant to the User. Most interaction is via email. Users can elect to opt out using the unsubscribe options in these emails. Collected information is only for the use of Exponential and will not be distributed further except in the following limited application: where authors make their resources such as eBooks, courses, videos and audios available for free in exchange for the email addresses of Users downloading their resources, email addresses will be provided to these authors. Authors are specifically required not to further distribute the information and only use it for their use in keeping Users informed of other future resources and opportunities.

Policy Against SPAM
Exponential distributes a weekly eNewsletter of high-quality, relevant content for church leaders. Exponential will not normally send email to Users more frequently than these weekly eNewsletters. Users can elect to unsubscribe from these eNewsletters using the links on the weekly emails.

Links to Other Sites
Our Site contain links to third-party sites that are not owned or controlled by Exponential.  Exponential has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party sites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit.

Limited License
Exponential grants you a non-exclusive, non-transferable, limited license to use the Site in accordance with this Agreement.

Termination
We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Limitation of Liability
In no event shall Exponential, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for damages, direct or consequential, resulting from your use of the Site, and you agree to defend, indemnify and hold us harmless from any claims, losses, liability costs and expenses, including but not limited to attorney fees, arising from your violation of any third-party’s rights.

Warranty Disclaimer
Your use of the Site is at your sole risk. The Site is provided on an “as is” and “as available” basis. The Site is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Exponential, its subsidiaries, affiliates, and its licensors do not warrant that a) the Site will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Site is free of viruses or other harmful components; or d) the results of using the Site will meet your requirements.

Governing Law
This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of Virginia, United States, without giving effect to any principles of conflicts of law.

Changes to This Agreement
We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.

Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.
